Work Hours: Monday – Friday, 8:30 AM – 4:30 PM CST (on-site, Memphis, TN)
License Context: DMHSAS-Licensed PSSA | TennCare Credentialed | All 3 MCOs (BlueCare, UHC, Wellpoint/Amerigroup)
Position Overview
BrightStar Care of Memphis & S Nashville is a licensed Personal Support Services Agency (PSSA) regulated by the Tennessee Department of Mental Health and Substance Abuse Services (DMHSAS) and credentialed with TennCare to serve Medicaid clients across all three managed care organizations in Shelby County. With a workforce of 100+ employees, we are seeking a detail-driven, compliance-minded HR Manager to own the full employee lifecycle — from pre-hire vetting and onboarding through ongoing credentialing, payroll coordination, and employee relations.
This is not a passive or remote-eligible administrative role. The HR Manager is an on-site, in-the-trenches operator who proactively tracks deadlines, chases down missing documentation, and treats credential lapses as a crisis before they occur. You will serve as the internal authority on federal employment law, Tennessee state requirements, and TennCare/MCO-specific HR obligations.
Key Responsibilities
1. Recruiting & Hiring
- Manage full-cycle recruitment for caregivers and administrative staff — job postings, application review, screening, interviewing, offer coordination, and onboarding initiation. Utilize company platforms (WorkBright/Connecteam), complete all legal requirements for new hires.
- Maintain applicant tracking records and all hiring documentation per retention requirements.
2. Background Checks & Registry Compliance
- Complete and document all background checks and registry clearances BEFORE any employee has direct client contact. Complete ongoing/recurring background checks as applicable by regulatory bodies.
- Drug screening — coordinated through a U.S.-based vendor with timely completion, proper documentation, and full compliance with Tennessee regulations and company policy — at hire, annually, and at random if necessary.
- Maintain all background check and registry documentation in each employee’s personnel file, available for MCO and DMHSAS audit review upon request.
3. New Hire Onboarding & Personnel File Compliance
- Maintain required contents of every employee’s personnel file per franchise, Joint Commission, TennCare, and State licensure requirements
- Retain all personnel files for a minimum of 2 years following termination per Tennessee PSSA statute.
- Conduct 90-day introductory period tracking; coordinate with supervisors to evaluate and document outcomes. Coordinate annual performance evaluations for all personal support services workers, assessing at minimum their ability to provide daily client support per DMHSAS requirements.
4. Training Documentation & Continuing Education
- Pre-Service Competency (must be documented before client contact): 12 hours of Continuing Education courses at hire and annually
- Conduct and Complete Ongoing / Annual Training, track and proactively manage credential expiration and annual documentation requirements
5. Payroll Coordination & Wage Compliance
- Oversee payroll processing for field and office staff, ensure all employees are classified correctly, ensure all payroll deductions are lawful under Tennessee wage deduction law, process and track commissions and performance bonuses per documented company policy
- Handle and manage unemployment claims, worker's compensation claims, and wage garnishments as they arise
6. Employee Relations, Discipline & Offboarding
- Serve as the primary point of contact for employee concerns, complaints, and conflict resolution.
- Administer and document the progressive discipline process consistently and in accordance with Tennessee at-will employment law: verbal warnings (documented), written warnings, PIPs, and termination.
- Conduct or coordinate workplace investigations involving misconduct, harassment, policy violations, or ANE allegations.
- Document any reportable events and lead monthly REM meeting for office staff.
- Report any terminations related to abuse, neglect, or misappropriation to applicable state registries as required by law.
7. Regulatory Compliance & Policy Management
- Ensure compliance with Federal Employment Law, Tennessee State Requirements, DMHSAS Licensure (TN Chapter 0940-05-38), TennCare / MCO Requirements, and Franchise Standards.
Requirements
Required:
- Minimum 4 years of HR management experience in a U.S.-based employer environment
- Demonstrated, working knowledge of Tennessee employment law and federal HR regulations: FLSA, FMLA, ADA, Title VII, FCRA, OSHA, and E-Verify
- Experience in home care, home health, healthcare, or staffing agency environments strongly preferred
- Familiarity with, or demonstrated ability to learn, Tennessee DMHSAS PSSA licensing requirements (Chapter 0940-05-38)
- Proven track record managing credential expiration, background check timelines, and compliance deadlines with precision — this is non-negotiable
- Hands-on experience coordinating criminal background checks, multi-registry screenings, and OIG/SAM.gov exclusion checks
- Experience with I-9 verification and E-Verify administration
- Strong written and verbal communication skills — must communicate clearly with caregivers, management, and regulatory contacts
- High discretion with sensitive and confidential employee information
- Must be able to work on-site in Memphis, TN, Monday–Friday
Preferred:
- Prior experience with a TennCare/Medicaid provider or DMHSAS-licensed agency
- Familiarity with TennCare CHOICES, ECF CHOICES, and MCO provider requirements
- PHR, SPHR, SHRM-CP, or SHRM-SCP certification
- Experience with ADP, WorkBright, Connecteam, or similar HRIS/onboarding platforms
- Understanding of non-compete and restrictive covenant enforceability under Tennessee law
- Familiarity with EVV systems and Medicaid billing environments
